What do i need to Sell my Property in Spain?
Selling your property can be (But doesn't need to be) a lengthy process; in the right hands we try to ensure that this isn’t the case.
Below you will find everything you need to know and do to successfully sell a property in Spain. These documents are necessary to list your property for sale in Spain effectively and efficiently. You can find more resources in our comprehensive Buyers Guide which is equally important to Vendors to know what Information buyers will be looking for.
The Title Deed (Escritura)
This is the Legal Document for your property and the information within that confirms and shows that you are the Legal owner.
Proof of Mortgage Cancellation (If Applicable)
This is carried out by your Lawyer during the conveyancing and due diligence process, the cancellation and expenses must be made so that the new buyer can register the property in his or her name. This operation is usually done by your Lawyer at the same time as the registration of the sale at the notaries office.
Spanish Property Tax (IBI) Receipts
The payment receipts and a certificate that proves you are up to date with payments are also necessary. The person responsible for paying this tax will be the person who owns the property. Again, your Lawyer will carry out the necessary checks to ensure that payments are up to date and that the buyer and new owner will not inherit any debt and purchase unencumbered.
Community fees (If applicable)
The community of owners or management company that is responsible for any communal facilities will provide this document, again showing that payments are up to date, or if any debt or payments outstanding are present. The urbanización with the approval of the president will provide a certificate of payment for any/all communal fees to be paid.
A copy of the rules for the community of owners will also be passed on to the buyers Lawyer.
Utility bills for Electricity, Gas, Water etc
Showing reference and/or account numbers, the most recent paid bills for each of the above.
Energy performance Certificate - EPC (Certificado de Eficiencia Energetica - CEE)
An energy performance certificate has been mandatory since 2013. The Owner must provide a copy of the Energy Performance Certificate, which will be provided to the Buyers Lawyer.
Technical Building Inspection (Inspección Técnica de Edificios or ITE)
If this document applies to the property, It’s necessary to provide it as part of the convenyancing.
Certificate of Habitability or Licence of First Occupation (LPO – Licencia de Primera Ocupación)
The Licence of First Occupation (also known as Habitation Licence or Certificate of Habitation
In Spanish - Licencia de Primera Ocupación or Cédula de Habitabilidad
This is a licence issued by the Town Hall and is granted once the building works have been completed, stamped and approved by the local authority. This is the document that proves the property is Legal and registered fully and properly.
